DEPARTMENT OF PUBLIC SERVICE REGULATION BEFORE THE PUBLIC SERVICE COMMISSION OF THE STATE OF MONTANA In re NW Services’ Application for Class D Certificate of Public Convenience and Necessity Docket 2025.03.026 June 26, 2025 Notice of Public Hearing 1. On April 29, 2025, NW Services submitted its finalized Application for Certificate of Public Convenience and Necessity (“Application”) to the Montana Public Service Commission (“Commission”). In its Application, NW Services requests Class D motor carrier authority to transport garbage between all points and places within Lincoln, Flathead, and Lake Counties. The requested authority is limited to commercial roll-off service only. Allied Waste Services of North America, LLC, d/b/a Republic Services of Montana, and Evergreen Disposal Inc. timely protested NW Services’ Application and are therefore parties to this proceeding. 2. PLEASE TAKE NOTICE that the Commission will conduct a public hearing on the Application. The public hearing will commence on July 16, 2025, at 9:00 a.m., at the Flathead County Fairgrounds Country Fair Kitchen Building, 265 N. Meridian Rd., Kalispell, MT 59901, and continue day-to-day as necessary through 5:00 p.m. on July 18, 2025. The Commission’s website (psc.mt.gov) will have a link to a live stream of the hearing. 3. The Commission will provide an opportunity for public comment at the beginning of each hearing day. Comment may be provided in person, by telephone, or by videoconference. Commenters participating remotely must sign up to receive participation instructions. The hearing is for the purpose of receiving evidence (testimony and exhibits) addressing NW Services’ Application. Testimony submitted at the hearing is subject to cross-examination. The parties may waive formal proceedings pursuant to Montana Code Annotated § 2-4-603 (2023). 5. The Commission will evaluate NW Services’ Application and evidence presented by the parties based on applicable legal standards. Mont. Code Ann. §§ 69-12-323(2), 69-12-415. If after the hearing, the Commission finds from the evidence that public convenience and necessity require authorization of NW Services’ proposed service or any part thereof, the Commission will issue a certificate of public convenience and necessity. Mont. Code Ann. § 69-12-323(2)(a). 6. Copies of NW Services’ Application are publicly available at the Commission’s business office, 1701 Prospect Avenue, Helena, MT 59601, and online at the Commission’s website (psc.mt.gov) under Docket 2025.03.026.
