The relief sought by Plaintiff ZT Properties LLC in this quiet title action is to have title to the Lincoln Parcel quieted in its name, alone, as against all Defendants, known and unknown, claiming or who might claim any right, title, estate, interest in, lien on, or encumbrance upon the Lincoln Parcel, and that all Defendants, known or unknown, be forever enjoined and barred from asserting any claim upon or to the Lincoln Parcel or any part thereof adverse to Plaintiff ZT Properties LLC. Plaintiffs do not seek to quiet title in this action such that the judgment and decree impugns or otherwise affects any of the following two items of record: (1) that Deed of Trust recorded August 15, 2024, in Book 406, Page 879, as Doc. 311806; and (2) that Deed of Trust recorded June 9, 2023, in Book 401, Page 835, as Doc. 306128, as assigned in that instrument recorded August 27, 2024, in Book 407, Page 36, as Doc. 311978.
