LEGAL NOTICE Notice of availability and public comment period on the Analysis of Brownfields Cleanup Alternatives (ABCA) document for the Kootenai Business Park property. The Montana Department of Environmental Quality (DEQ) is seeking public comment on a document analyzing several options for cleanup of contaminated structures on the Kootenai Business Park property, located at 60 Port Blvd in Libby, Montana. DEQ, in collaboration with the Lincoln County Port Authority, Noble Investment Properties, and the U.S. Environmental Protection Agency, prepared the ABCA to address abatement of non-Libby Amphibole asbestos containing hazardous materials in multiple structures on the site with the goal of cleaning up the property to allow for future redevelopment. Cleanup alternatives identified in the ABCA include taking no abatement action, abatement and appropriate disposal of asbestos-containing materials prior to demolition, or demolition and disposal of buildings as regulated asbestos waste. DEQ is accepting public comments on the ABCA through April 23, 2024. SECTION 00100 INVITATION TO BID Separate sealed bids for construction of  Libby 2024 Wastewater System Improvements will be received by the  City of Libby Public Works Department, 952 East Spruce Street, Libby, Montana, 59923, until   2:00 pm   local time April 24th, 2024, and then publicly opened and read aloud. The project consists of:  Replacement of three (3) select sewer mains totaling 806 lineal feet, and service line re-connections, by traditional trench excavation methods.   The contract documents consisting of Drawings and Project Manual can be obtained at the office of TD&H Engineering, 450 Corporate Drive, Suite #101, Kalispell, Montana, 59901, in accordance with Article 2.01 of Instructions To Bidders.  The required deposit is $ 75.00 per set, which is not refundable. The Bid Submittal must include the purchased Project Manual in its entirety.  Or The contract documents consisting of Drawings and Project Manual in accordance with the Instruction to Bidders, may be examined or viewed at the Flathead Valley Plans Exchange located at 2303 Hwy 2 East, Kalispell, MT. CONTRACTORS and any of the CONTRACTORS’ subcontractors bidding or doing work on this project will be required to be registered with the Montana Department of Labor and Industry (DLI).  Forms for registration are available from the Department of Labor and Industry, P.O. Information on registration can be obtained by calling 1-406-444-7734.  CONTRACTOR is not required to have registered with the DLI prior to bidding on this project but must have registered prior to execution of the Construction Agreement.  The CONTRACTOR must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex or national origin. Federal Prevailing Wages apply to this contract. The CONTRACTOR(s) and all subcontractors shall pay employees involved in the performance of the construction work according to the Laws of the United States and the State of Montana in accordance with the schedule of Davis-Bacon prevailing wage rates established by the United States Department of Labor and/or the schedule of Montana Prevailing Wage Rates established by the Montana Department of Labor and Industry included in the Project Manual. Each bid or proposal must be accompanied by a Certified Check, Cashier’s Check, or Bid Bond payable to City of Libby, in an amount not less than ten percent (10%) of the total amount of the bid.  Successful BIDDERS shall furnish an approved Performance Bond and a Labor and Materials Payment Bond, each in the amount of one hundred percent (100%) of the contract amount.  Insurance as required shall be provided by the successful BIDDER(s) and a certificate(s) of that insurance shall be provided. The selection of Low Bidder will be based on the Total Bid for all Schedules. The right is reserved to reject any or all proposals received, to waive informalities, to postpone the award of the contract for a period of not to exceed sixty (60) days, to award only Schedule 1 or only Schedules 1 and 2, and to accept the lowest responsive and responsible bid which is in the best interest of the OWNER. No bid may be withdrawn after the scheduled time for the public opening of the Bids specified above. The right is reserved to reject any or all proposals received, to waive informalities, to postpone the award of the contract for a period of not to exceed sixty (60) days, and to accept the lowest responsive and responsible bid which is in the best interest of the OWNER.  The project is funded in part or in whole with grant/loan funding from the State of Montana American Rescue Pan Act (ARPA), Montana Department of Commerce Montana Coal Endowment Program; Montana Department of Commerce Community Development Block Grant; and Department of Natural Resources Renewable Resources Grant and Loan Program. Award of the project will be contingent upon receiving funding and award concurrence from these programs.
