REQUEST FOR PROPOSALS PROJECT MANAGEMENT SERVICES   The City of Libby has been given a federal Community Development Block Grant (CDBG), Montana Coal Endowment Program Grant (MCEP) and Renewable Resource Grant (RRG) by the Montana Department of Commerce (DOC) and Montana Department of Natural Resources, respectively, for design and construction of a new control system for the wastewater treatment plant and to replace several sections of sewer mains. The City of Libby is soliciting proposals for project management services to assist the City in the administration of this project in compliance with all applicable requirements under the Montana CDBG, MCEP and RRG Programs as described in the current edition of the each program Grant Administration Manual.  Payment terms will be negotiated with the selected offeror. The fee for project management services will be paid with funds from the two programs. Project management services will be coordinated with the City and Grant Administrator. Primary duties of the Project Manager are summarized below: 1.Preparing all written reports, checklists, or legal notices required to assure compliance with federal and state environmental requirements; 2.Drafting a management plan and contract for review and approval by the DOC; 3.Establishing and maintaining project files and preparing all documentation and reports required for administration of the grant; 4.Assist the City in administration of the Engineering Agreements, review engineering plans, contractor selection, construction administration and completion. 5. Assist the City Attorney in preparation of a Site Title Opinion by identifying and procuring necessary documentation.  6.Review all proposed project expenditures to ensure their propriety and proper allocation to the project budget; 7.Monitor expenditures and budgeted services of the Engineer and Contractor. 8.Participating in the pre-construction conference and periodic construction progress meetings; 9.Serve as the City of Libby’s designated Labor Standards Officer and assuring compliance with all applicable labor standards requirements; 10.Assuring compliance with all applicable civil rights requirements; 11.Attending City Council meetings, as needed or requested, to provide project status reports and representing the project at any other public meetings deemed necessary; and 12.Preparing all required performance reports and closeout documents and assisting the City with the determination of applicable audit requirements. The services will not include the disbursement or accounting of funds distributed by City’s, legal advice, fiscal audits, or assistance with activities not related to the project. Responses should include: 1.the firm’s legal name, address, and telephone number; 2.the principal(s) of the firm and their experience and qualifications; 3.the experience and qualifications of the staff to be assigned to the project 4.a description of firm’s prior experience, including any similar projects, particularly those with multiple funding sources, similar size of the community, location, total construction cost, and name of local official knowledgeable regarding the firm’s performance.  Include at least three references; 5.a description of the firm’s current work activities, how these would be coordinated with the project, and the firm’s anticipated availability during the term of the project; and Respondents will be evaluated according to the following factors: A. Legal Notice   Comprehensive Five-Year Bond Review for Montanore Minerals Corporation (MMC) (Hard Rock Mining Operating Permit No. 00150)   The Department of Environmental Quality (DEQ) is conducting a comprehensive bond review for Operating Permit No. 00150 issued to MMC. MMC’s facility and associated disturbances are located approximately 20 miles south of Libby in T27N, R31W.   DEQ has determined that the current bonding level does not represent the present costs of compliance with the Metal Mine Reclamation Act, administrative rules adopted thereunder, and the operating permit. DEQ is proposing a bond increase of $998,935 (from $1,154,996.00 to $2,153,931.00. The bond increase is largely due to an updated anAalysis of the cost of installing a hydraulic bulkhead in the existing tunnel during closure, as well as changes in fuel price and equipment rates, updated indirect costs such as mobilization, contingency, administration, etc.   This bond addresses the costs associated with reclamation and closure of the existing facilities and disturbances at the site (DEQ Approved Phase 1). The US Forest Service (USFS) is currently reviewing plans to extend the existing tunnel for purposes of mineral deposit definition drilling and hydrogeologic assessment (DEQ Approved Phase 2). If the USFS authorizes MMC’s project (DEQ Approved Phase 2), a determination of the additional bond required for that phase of the project would be developed in coordination with the USFS.    The procedure for adjusting bonds as a result of a comprehensive bond review is set forth in Section 82-4-338(3), MCA. The company and the public will have until October 31, 2023 to comment on the proposed bond increase. DEQ will issue a final bond determination after the comment period has expired. The company, or any person with an interest that may be adversely affected by DEQ’s final bond determination, may obtain a contested case hearing before the Board of Environmental Review.
