NOTICE OF CLOSE OF VOTER REGISTRATION AND OPTION FOR LATE REGISTRATION FOR SCHOOL DISTRICT ELECTIONS NOTICE IS HEREBY GIVEN that regular* registration for elections to be held on May 2, 2023 will close at 5:00 p.m. on Monday, April 3, 2023. To register to vote, or to update your name, address, or other voter information, submit the voter registration application to the county elections office. The following school districts are scheduled to hold a May 2, 2023 election; however, their elections may be canceled if trustee positions are not contested and there are no other ballot issues to vote on: LINCOLN COUNTY SCHOOL DISTRICTS 1, 4, 13, 14, 15, 24 and 53. All active and inactive electors of the above-mentioned school districts are entitled to vote in the election for the district in which they reside. **For districts holding a mail ballot election, ballots will be automatically mailed to registered electors with an active status by April 17, 2023. For districts holding a polling place election, ballots will be mailed to absentee voters only on April 12, 2023. PUBLIC NOTICE Notice of application for a Licensed Landfill Conditional Air Quality Open Burning Permit (pursuant to the Lincoln County Air Pollution Control Ordinance Chapter 1, Subchapter 4, Outdoor Burning Regulations) Lincoln County Solid Waste filed on March 1st, 2023, an application for conditional air quality open burning permits from the department. Applicant seeks approval of its application to open burn wood waste piles at the Eureka, and Troy Landfills. Any member of the public with questions or who wishes to receive notice of Air Quality Control of the Lincoln County Department of Environmental Health’s determination, and the location where a copy of the application can be reviewed, or to submit comments on the application, must contact the department at 418 Mineral Avenue, Libby, Montana 59923, Phone 406-283-2442, FAX 406-293-5640, e-mail lcdeh@libby.org. The department’s decision to approve or deny any application for a conditional open burning permit may be reviewed by the City-County Board of Health for Lincoln County according to the following procedure: When the department approves or denies the application for a conditional open burning permit under this section, a person who is jointly or severally adversely affected by the decision may request, within 15 days after the department renders its decision, upon affidavit setting forth the grounds therefore, a hearing before the board. The department’s decision on the application is not final unless 15 days have elapsed and there is no request for a hearing under this section. The filing of a request for a hearing postpones the effective date of the department’s decision until the conclusion of the hearing and issuance of a final decision by the board. COMBINED NOTICE: FINDING OF NO SIGNIFICANT IMPACT and NOTICE TO PUBLIC OF REQUEST FOR RELEASE OF FUNDS (FONSI/NOI/RROF) March 28, 2023 Lincoln County 512 California Ave Libby, MT 59923 406-293-7781 TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS: On or before 13th of April the above-named Lincoln County will request the Montana Department of Commerce (DOC) to release Community Development Block Grant (CDBG) funds provided under Title I of the Housing and Community Development Act of 1974, as amended (PL 93-383) for the following project: Libby Creek Community Water and Wastewater Improvements The project will extend City of Libby water main to connect City water service to Libby Creek Community. The existing septic systems on the site will be abandoned and replace them with a public sewer in Lincoln County. Finding of No Significant Impact It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly the above named Lincoln County has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190). Additional project information is contained in the Environmental Review Recoord (ERR) on file at NeighborWorks Montana, 17 5th St S, Great Falls, MT 59401 or by request by contacting NeighborWorks Montana at 406-406-4540 and may be examined or copied weekdays 8:30 AM to 4:00 PM. No further environmental review of such project is proposed to be conducted prior to the request for release of CDBG project funds. Public Comments on Findings All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by Lincoln County to the Project Manager, NeighborWorks Montana at roc@nwmt.org or PO Box 1025, Great Falls, MT 59401 on or before April 17, 2023. All such comments so received will be considered and Lincoln County will not request release of funds or take any administrative action on the project prior to the date specified in the preceding sentence. Release of Funds Lincoln County will undertake the project described above with CDBG funds provided by DOC under Title I of the Housing and Community Development Act of 1974, as amended. Lincoln County is certifying to DOC that Jim Hammons, in his official capacity as Lincoln County Commissioner consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision-making, and action; and that these responsibilities have been satisfied. The legal effect on the certification is that upon its approval, Lincoln County may use the CDBG funds and DOC will have satisfied its responsibilities under the National Environmental Policy Act of 1969. Objections to State Release of Funds The Department of Commerce will accept an objection to its approval of the release of funds and acceptance of the certification only if it is on one of the following bases: (a) that the certification was not in fact executed by the chief executive officer or other officer approved by the Department of Commerce; (b) that the applicant’s environmental review record for the project indicates omission of a required decision, finding, or step applicable to the project in the environmental review process; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by DOC; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental design. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and may be addressed to: Department of Commerce, Community Development Division, 301 S. DEQ Seeks Comment on Draft Sitewide Operations and Maintenance Plan and Institutional Control Implementation and Assurance Plan for the Libby Asbestos Superfund Site The Department of Environmental Quality (DEQ) is accepting public comment on a draft sitewide Operations and Maintenance Plan (O&M Plan) and Institutional Control Implementation and Assurance Plan (ICIAP) for the Libby Asbestos Superfund Site in Lincoln County. DEQ is responsible for the implementation of O&M activities, ensuring that the controls in place across the site remain protective of human health and the environment. The Libby Asbestos Superfund Site was added to the Environmental Protection Agency’s (EPA) National Priorities (superfund) list in 2002 due to asbestos contamination that resulted from the vermiculite mine and associated facilities operated by W.R Grace from 1963 to 1990. The O&M Plan and ICIAP are consolidations of existing operable unit (OU) specific documents drafted and implemented by EPA and DEQ. The intent of the sitewide O&M Plan and ICIAP is to ensure consistency of O&M implementation in OUs 1, 2, 4, 5, 7, and 8, and to ease the accessibility of information. These operable units include the cities of Libby and Troy, the former screening and export plants, and the former Stimpson Lumber Mill. The operable units that include the former Libby Mine site (OU3) and the Burlington Northern Santa Fe Railway (OU6), are not included in the sitewide O&M Plan or ICIAP. EPA remains the lead agency for those operable units with DEQ providing a supporting agency role. DEQ will accept public comment on the draft documents until April 23, 2023.
