Justice Gustafson stands up for Libby, now it is time to support her

McGarvey Law represents many folks in Libby affected by asbestos contamination. As part of our commitment to Libby, we are writing to urge the voters of Libby to re-elect Justice Gustafson to the Montana Supreme Court.

The Montana Supreme Court election in November will be critical for the community of Libby, directly affecting cases for those harmed by asbestos contamination.

In every case in front of the Montana Supreme Court during her time on the bench, Justice Gustafson has ruled in support of justice for the people of Libby.

In Maryland Casualty Company vs. the Asbestos Claims Court, Justice Gustafson held MCC accountable for not only their failure to act, but also for concealing the asbestos exposure risk. Further, in BNSF v. Asbestos Claims Court, Justice Gustafson again stood up for Libby and joined the unanimous Court in finding BNSF strictly liable for its highly contaminated railyard in downtown Libby.

If re-elected, Justice Gustafson will continue to uphold the law in support of the community of Libby.

Justice Gustafson’s opponent, James Brown, lacks the experience and credibility expected of this State’s highest judicial office. He has worked in several political capacities, but never in a judicial capacity. Being nonpartisan is essential to the fair administration of justice — this requirement stems from the fundamental principle of separation of powers rooted in both the U.S. and Montana Constitution.

Appointed by Governor Judy Martz and endorsed by Libby’s own Governor Marc Racicot, supported by nonpartisan judges and former justices across the State of Montana, Justice Gustafson is the clear choice.

McGarvey Law urges the voters of Libby to vote for the experienced, nonpartisan candidate. Justice Gustafson has repeatedly stood up for the community of Libby, now it is time we do the same for her.
