The City of Troy Montana is seeking bid proposal from qualified firms to conduct air sampling of their gravel pit for natural occurring asbestos. Sampling must be taken during work activities when the City or County employees are performing work. This work may include hauling and stockpiling of materials, mass excavation of existing materials, and/or aggregate crushing activities. Sampling activities will include personal monitoring, area monitoring and fugitive dust monitoring. The qualified firm will provide all labor and equipment to conduct the air monitoring and analyzing of the samples taken. PCM air samples will only be analyzed by laboratories accredited by the American Industrial Hygiene Association (AIHA) or laboratories that participate in the AIHA proficiency analytical testing (PAT) program and that have received a "proficient" rating. Legal Notice Comprehensive Five-Year Bond Review and Proposed Partial Bond Release for Troy Mine Inc. (Hard Rock Mining Operating Permit No. 00093) Located in Lincoln County, MT The Department of Environmental Quality (DEQ) has received a request for bond release from Troy Mine Inc. (TMI). TMI is authorized to operate an underground copper/silver mine and mill under Operating Permit No. 00093. The site is located on private and United States Forest Service lands in Sections 31 and 32 of Township 30 North Range 33 West, Sections 5, 6 and 7 of Township 29 North Range 33 West, Sections 12, 13, 14, 23, 24, 25, 26, 35 and 36 of Township 29 North, Range 34 West, and Sections 5 and 6 of Township 28 North, Range 33 West, approximately 10 to 15 miles south of the town of Troy in Lincoln County. DEQ currently holds a reclamation bond in the amount of $16,718,502. DEQ is proposing to release $1,508,219 and retain $15,210,283 after both releasing bond for completed reclamation tasks and increasing the bond as a result of a comprehensive bond review. The bond release was requested by the operator for the partial completion of reclamation, which includes demolition of the office/administration building, the secondary crusher building, the fine ore bin, the shop buildings, several other smaller buildings located at the mill and office sites, and the concrete foundations associated with each structure. Also, the mine's south portal has been backfilled and the surrounding area reclaimed. DEQ has determined the partial completion of reclamation would decrease the currently required bond by $2,468,918, resulting in a required bond of $14,249,584. In addition to the request for bond release, DEQ is conducting a comprehensive bond review for Operating Permit No. 00093. DEQ has determined that the current bonding level does not represent the present costs of compliance with the Metal Mine Reclamation Act, administrative rules adopted thereunder, and the operating permit. DEQ is proposing to increase the bond by $960,699. The bond increase is largely due to changes in fuel price, equipment rates, and updated indirect costs such as mobilization, contingency, and administration. DEQ has determined the net effect on the bond from the release request ($2,468,918) and increase as a result of the five-year comprehensive review ($960,699) is a bond release of $1,508,219. The procedure for adjusting bonds as a result of a comprehensive bond review is set forth in Section 82-4-338(3), MCA. Pursuant to Section 82-4-338(5), Montana Code Annotated (MCA), DEQ may not release or decrease a reclamation bond until the public has been provided an opportunity for a hearing and a hearing has been held if requested. The company and the public will have until Tuesday, March 8, 2022, to comment on these proposed changes to the bond amount. DEQ will issue a final bond determination after the comment period has expired. The company, or any person with an interest that may be adversely affected by DEQ's final bond determination, may obtain a contested case hearing before the Board of Environmental Review. A written request for a hearing must be filed with DEQ within 30 days of the issuance of the final bond determination, stating the reason for the request. NOTICE This notice is in regards to the State of Montana's permitting requirements for a proposed 14.4- acre gravel pit and processing facility along Farm to Market Road at the intersection with Hammer Cutoff Road, 8.5 miles southeast of Libby. The site is located in S19, T29N, R30W. Approximately 650,000 cy of material will be removed from the entire site and approximately 20,000 cy of soil and overburden will be stripped, stockpiled, and later used for reclamation.
