RESOLUTION FOR DISPOSAL OF SURPLUS PROPERTY WHEREAS, pursuant to Section 20-6-604 of the School Laws of Montana, the Trustees of Libby School District No. 4 may sell or otherwise dispose of personal school property which has become obsolete, undesirable, or unsuitable for school purposes; NOW, THEREFORE, BE IT RESOLVED That Libby School District No. 4 declares the following list of personal property as surplus property to be disposed of; 8' x 10' Freezer Western Pickup Snow Plow 2 - Toro Lawnmowers Miscellaneous Books, Furniture, & Equipment BE IT FURTHER RESOLVED, That said property may be sold by Libby School District No. 4 on an "as-is" basis, without warranty. This Resolution shall become effective fourteen (14) days after publication and posting as required by Section 20-20-204 of the School Laws of Montana. Any taxpayer may appeal this Resolution prior to September 27, 2018, by filing a verified petition with the Clerk of the District Court and serving a copy of such petition upon the School District. The petition shall set out in detail the objections of the petitioner to the adoption of the Resolution or the disposal of the property. PUBLIC NOTICE LINCOLN COUNTY RURAL FIRE DISTRICT ANNEXATION PUBLIC HEARING The Lincoln County Rural Fire District presented petitions for annexation to the Lincoln County Board of Commissioners on August 22, 2018. Pursuant to 7-33-2125(b) MCA, the County Commission is required to set a public hearing on the petitions not less than 4 weeks after the date of the presentation. The Lincoln County Board of County Commissioners did pass Resolution of Intent No. 2018-16 on August 29, 2018. Pursuant to 7-33-2125(2), M.C.A. states, "On the date set for the hearing, the Board of County Commissioners shall consider the petition and any objections to the annexation. The board shall approve the annexation unless a protest petition signed by at least 40% of the owners of real property in the area proposed for annexation and owners of property representing 40% or more of the taxable value of the property in the area proposed for annexation is presented at the hearing, in which case the annexation must be disapproved". Pursuant to 7-33-2103(b), M.C.A. states, "Signatures may not be withdrawn fewer than 20 days before the date set for adoption of the petition".
