NOTICE OF TRUSTEE'S SALE TO WHOM IT MAY CONCERN: 1. Property. This Notice concerns the following described real property (the "Property") located in Lincoln County, Montana, and more particularly described as follows: A parcel of land located in the SE 1/4 of Section 5, Township 26 North, Range 27 West, P.M.M., Lincoln County, Montana, as shown and described on CS#835, records of Lincoln County, Montana. 2. Deed of Trust. The Grantor named below executed and delivered to the Beneficiary named below a Deed of Trust covering the Property. The Deed of Trust is described as follows: Date: March 17, 2011 Grantor: Charles T. Metcalf, aka Charles Tod Metcalf, Howard F. Metcalf and Gertrude M. Metcalf Trustee: C. Mark Hash Beneficiary: Glacier Bank Recorded in the records of Lincoln County, Montana, as follows: Date: March 28, 2011 Time: 2:19 p.m. Instrument No: 231750 Book: 336 Page: 361 3. Note. The Deed of Trust was given to secure payment of a Promissory Note in the original principal amount of $58,653.18 from Grantor to the Beneficiary. The Promissory Note is dated March 17, 2011. Said Promissory Note was modified by a Change in Terms Agreement dated October 19, 2015. 4. Substitute Trustee. Randall S. Ogle, an attorney living in Kalispell, Montana, was substituted as trustee by a written document recorded in the records of Lincoln County, Montana, as follows: Date: February 10, 2017 Instrument No: 267553 Book: 366 Page: 550 5. Default. Grantor, or their successors in interest, have defaulted under the Promissory Note and Deed of Trust in that they failed to pay the entire balance due and owing on said Promissory Note when due, the amount of said default being $57,964.83, including penalty, interest and late fees to February 3, 2017, plus all taxes, penalty and interest due thereafter. 6. Amount Owing. The amount owing under the Promissory Note and Deed of Trust is the sum of $57,964.03, plus interest at the rate of 6.00% per annum from February 2, 2017, to the date of payment, plus all taxes, penalty and interest, costs and attorneys fees which are allowed by law. 7. Acceleration. Notice is hereby given that the Beneficiary under the Deed of Trust and the undersigned Substitute Trustee have elected and do hereby elect to consider all principal and interest to be immediately due and payable in consequence of the default of Grantor under the Promissory Note and Deed of Trust. 8. Notice of Sale: Notice is hereby given that the Beneficiary under the Deed of Trust and the Substitute Trustee hereby elect to sell or cause to be sold the Property described above to satisfy the obligations secured by the Deed of Trust.
