Troy man arrested for fourth DUI

James Lee Reid, 38, of Troy, was recently arrested for his fourth offense of allegedly driving under the influence of alcohol or drugs, a felony.

According to the affidavit of probable cause filed by Sheriff Deputy Benjamin Fisher, Fisher was asked to help locate Reid for failing to check in with his probation officer. Reid’s probation officer informed Fisher that Reid was to be arrested upon contact for a probation violation.

While checking a residence in Troy, Reid pulled up in his vehicle. Fisher wrote in the affidavit that, when Reid saw Fisher and his probation officer, he started to back up and then stopped. Reid then exited the vehicle and started to walk towards the rear. Fisher then stopped Reid and placed him into handcuffs.

Fisher wrote in the affidavit, that while Reid was speaking with his probation officer and Lincoln County Detective Nate Scoffield, Fisher could smell an odor of alcohol.

After transporting Reid to the detention center, Fisher conducted a DUI investigation based on the strong smell of alcohol coming from Reid. Reid’s breath sample was reportedly a 0.104.

Reid has three prior DUI conviction in 2004, 2005 and 2010.

If convicted, he could face a minimum of 13 months to the Department of Corrections to complete a residential alcohol treatment program. Once the alcohol program is completed, he may serve the remainder of the 13 months on probation. The initial 13 months could be followed by a maximum of five years to the Department of Correction or the state prison, with fines up to $10,000.
