Three Libby residents plead not guilty to drug and other charges

One Libby man and two Libby women on Monday, July 17 pleaded not guilty in 19th Judicial District Court in Libby to various charges stemming from the results of a search warrant.

Calvin Paul St. Onge, 57, pleaded not guilty to charges of criminal possession of dangerous drugs, a felony, and driving while suspended/revoked, a misdemeanor. Jana Jo Roberts, 45, and Rebecca E. Deshazer, 37, pleaded not guilty to three charges of criminal possession of dangerous drugs, all felonies, and one charge of criminal possession of drug paraphernalia, a misdemeanor.

St. Onge was charged June 30 with one felony count of criminal possession of dangerous drugs and a misdemeanor count of driving while suspended/revoked. If convicted St. Onge could face imprisonment for not less than two years and more than five years and may be fined not more than $50,000 on the felony charge.

Roberts and Deshazer both were charged June 30 with three counts of criminal possession of dangerous drugs. If Roberts and Deshazer are convicted they could face imprisonment for not less than two years and more than five years and may be fined not more than $50,000 on the felony charge on each charge.

According to court documents, Lincoln County Sheriff’s Office Deputy Boyd White applied for and received a search warrant to search the residence at 30572 US Hwy 2, lot C-7 for dangerous drugs. That search warrant included the vehicle, a 1998 Dodge, that St. Onge was driving. Sheriff’s Officer Benjamin Fisher assisted Sheriff’s Detective Nate Scofield with the traffic stop. Fisher confirmed that St. Onge was driving on a suspended/revoked license. St. Onge was transported to the Lincoln County Detention Facility by Fisher. While Lincoln County Sheriff’s Office Detention Officer Cutsforth was searching St. Onge he found a small baggie containing a crystalline substance in a small watch pocket in St. Onge’s jeans. Fisher took possession of the substance to test, which came back presumptively positive for methamphetamine.

The court documents associated with Roberts and Deshazer show that White, while executing the aforementioned search warrant, located three adults — Roberts, Deshazer and Kyle Dean Nick, who has yet to be arraigned — in a room standing around a bed. Inside the room were several syringes, spoons with residue, controlled prescription pills, a baggie that contained a crystal substance which field tested positive as methamphetamine, and glass pipes with residue that also tested positive for methamphetamine. All three were arrested and transported to the Lincoln County Detention Center.

Deshazer’s attorney Ryan Peabody requested an order of release on her own recognizance. Deputy County Attorney Jeffrey Zwang did not oppose the motion, and District Court Judge Matt Cuffe agreed to the release as long as Deshazer adhered to the conditions of release issued by Justice of the Peace Jay Sheffield.

Roberts’ attorney Charles Sprinkle advised the court that he would be petitioning the court for an order to release and paperwork for that would be filed in the upcoming days. Roberts will remain incarcerated at the Lincoln County Detention Center until an order for release is signed or she has a hearing on her request for release.

St. Onge’s attorney Ryan Peabody did not request an order of release. St. Onge will remain incarcerated at the Lincoln County Detention Center.

Deshazer, Roberts and St. Onge will have their next court appearance will be an Omnibus Hearing on August 28.

Kyle Dean Nick is scheduled for an arraignment on Monday, July 24 for his charges associated with this case.
