Libby man pleads not guilty to fifth DUI

A Libby man on Monday pleaded not guilty to his fifth driving under the influence charge and driving with a revoked driver’s license.

Charles William Mizenberg, 52, of Libby, pleaded not guilty to driving under the influence of alcohol and driving with a license revoked after a past DUI conviction. District Judge James Wheelis set his next hearing for Aug. 29. If convicted, Mizenberg could face no more than six months in prison and a $500 maximum fine.

Mizenberg was arrested on July 20 after a Cabinet Peaks Medical Center employee called Lincoln County Dispatch to report two men driving to and from the hospital while intoxicated. A detective with the Lincoln County Sheriff’s Office pulled Mizenberg over, driving a vehicle belonging to another man. According to court documents, Mizenberg failed several field sobriety tests after he was pulled over and refused to provide a breath sample. After he was arrested, court documents say that a blood sample showed Mizenberg’s blood alcohol content to be at .190, more than twice the legal limit.

According to court documents, Mizenberg has four previous DUI convictions from 1989 to 2001.
