Libby man sentenced Monday morning, arrested at noon

A Libby man sentenced to four years suspended on Monday was arrested for an alleged probation violation just two hours after his sentencing.

Fernando Munguia, of Libby, was arrested on a probation violation around noon on Monday after the Adult Probation and Parole office called the Lincoln County Sheriff’s Office to report Munguia’s violation. The Western News was not able to obtain the details of his violation by press time.

Two hours before the arrest, District Judge James Wheelis sentenced Munguia to four years suspended with the State Department of Corrections. Munguia was charged with criminal possession of dangerous drugs in February, 2015, criminal distribution of dangerous drugs 11 days later and again charged with felony possession in August.

In April, Munguia pleaded guilty to the first count of felony possession; the other two charges were dropped in accordance to a plea agreement with the county attorney’s office.

As part of his suspended sentence, Munguia could now be facing his full four-year sentence in state prison.
