The improvements and any other personal property on the cabin/home sites are owned by the lessee or other 3rd party. The successful bidder shall be required to pay the appraised value of the improvements in addition to the purchase price of the cabin/home site determined by the highest bid at the auction in accordance with M.C.A. 77-2-318. 2. The minimum acceptable bids for the land are the values indicated above. 3. The parcel will be sold to the high bidder of that parcel. However, the current lessee of the parcel shall retain the option to exercise their preference right for purchase by matching the high bid for that parcel. If that right is exercised, the lessee will be deemed the purchaser of the parcel. If the preference right is not exercised, the high bidder shall be deemed to be the purchaser. The high bidder will be responsible to pay the lessee for the value of improvements located on the property. 4. NOTICE The Montana Department of Revenue, Liquor Licensing, announces the availability of one Montana Retail On-Premises Consumption Restaurant Beer and Wine License for the Libby area. The Libby area includes the incorporated city/town of Libby and that portion of Lincoln County situated within five miles of the incorporated city/town limits. The license cannot be used to conduct any gaming or gambling activity on the premises. 16-4-420(1)(c), MCA If we receive more applications than there are available licenses, we will hold a lottery drawing. If you want to apply for one of the licenses, you must submit a lottery application. The lottery application is online at revenue.mt.gov under Liquor Control. On the application, list the name of the applicant(s) including all potential owners, corporate stockholders, all partners of a partnership, and all members of a limited liability company. This application is due no later than January 6, 2017. We will not consider late, unsigned, or incomplete applications. ARM 42.12.406 We can accept only one lottery application per person for this area. A "Person" as defined in the Administrative Rules of Montana is any individual, firm, partnership, limited liability company, corporation, or association. If a lottery is necessary, the drawing will take place in Helena to determine who can apply for this license. We will notify applicants of the date, time, and place for the drawing. Applicants do not need to be present to be chosen. Those chosen in the lottery drawing must to submit a license application within 30 days. The license application needs to have ownership information identical to what was listed on the lottery application. ARM 42.12.406(7).
