Lincoln County Sheriff seeking fugitive

The Lincoln County Sheriff’s Office is requesting the public’s assistance in apprehending Trysten Axel Allen, who is wanted for absconding from probation.

Allen was arrested Aug. 10, 2014, by Deputy Ben Fisher of the Lincoln County Sheriff’s Office. According to the narrative filed with the affidavit of probable cause, Fisher was dispatched to the Souse Gulch area to investigate a report of possible marijuana use. Fisher observed Allen, driving the reported vehicle traveling south on FDR Road toward Highway 37. After witnessing the vehicle cross the center line, Fisher pulled over the vehicle over. 

“I stopped the car based on the driving behavior, because after getting a report of possible marijuana use I believed the driver was showing signs of possibly being under the influence,” Fisher wrote. 

Based upon a plea agreement in the case, Allen was given a two-year deferred imposition of sentence in February 2015, and ordered into the supervision of Adult Probation and Parole. As part of his sentence, Allen was required to obey all laws and abstain from the use of alcohol or illegal drugs.

Probation and Parole Officer Steve Watson filed a report Sept. 8, 2015, alleging violations of five of the conditions of Allen’s release. The violations included use of alcohol and drugs, failure to comply with applicable laws, failing to keep his records updated with Probation and Parole, maintaining contact with probation officers and obtain a chemical dependency evaluation.

Watson characterized Allen as unwilling to comply with the terms of his probation.

“The defendant has only been on supervision for a period of seven months,” Watson wrote. “He has committed violations and failed to comply with treatment. The defendant has absconded from supervision and can’t be found. the defendant will need to have more structure due to his unwillingness to comply.”

Based upon Watson’s report and a petition to revoke filed Aug. 27, Judge James Wheelis issued a felony warrant for revocation of sentence. 

The Lincoln County Sheriff’s Office reported Allen was seen in the Libby area as recently as Nov. 9 and is requesting anyone with information regarding his whereabouts call dispatch at 293-4112 and report it immediately.
