KNF: Burn permits necessary on private land
The official State of Montana Forest fire season has arrived, and as of now, burning permits are required for any type of debris burning on all private land.
During the legal fire season (May 1 – Sept. 30) persons must obtain written authorization from a recognized fire protection agency before lighting any debris fire.
The U.S. Forest Service, Department of Natural Resources and Conservation and the Rural Fire District are the recognized fire protection agencies in this area that issue State of Montana Burning Permits.
The fire protection agency may deny, restrict or rescind any authorization by notifying the person conducting the burn.
An on-site assessment may need to be completed prior to issuing an individual a burning permit.
An individual requesting a burning permit for a debris fire that was ignited prior to May 1 may be directed to put the debris fire completely out.
Under the provision of Montana State Statute 50-63-103 the permit holder is liable for any and all fire suppression costs and damages resulting from an escaped and/or uncontrolled fire.
Persons are liable for fires despite the fact you have been issued a State of Montana Burning Permit.
All burning projects within the Libby Impact Zone (Air Pollution Control District) must comply with the Department of Environmental Quality.
