Anyone may appear at the hearing and have their comments heard regarding the amendment. PUBLIC NOTICE Notice of application for a Licensed Landfill Conditional Air Quality Open Burning Permit (pursuant to the Lincoln County Air Pollution Control Ordinance Chapter 1, Subchapter 4, Outdoor Burning Regulations) Lincoln County Solid Waste filed on September 15th, 2022, an application for conditional air quality open burning permits from the department. Applicant seeks approval of its application to open burn wood waste piles at the Eureka, and Troy Landfills. Any member of the public with questions or who wishes to receive notice of Air Quality Control of the Lincoln County Department of Environmental Health's determination, and the location where a copy of the application can be reviewed, or to submit comments on the application, must contact the department at 418 Mineral Avenue, Libby, Montana 59923, Phone 406-283-2442, FAX 406-293-5640, e-mail lcdeh@libby.org. Any comments on the application must be submitted to the department by no later than 5:00 P.M. on Tuesday, October 4th, 2022. Comments may be submitted in person (418 Mineral Avenue), by FAX (406-293-5640), or by E-mail (lcdeh@libby.org). The department's decision to approve or deny any application for a conditional open burning permit may be reviewed by the City-County Board of Health for Lincoln County according to the following procedure: When the department approves or denies the application for a conditional open burning permit under this section, a person who is jointly or severally adversely affected by the decision may request, within 15 days after the department renders its decision, upon affidavit setting forth the grounds therefore, a hearing before the board. The department's decision on the application is not final unless 15 days have elapsed and there is no request for a hearing under this section. The filing of a request for a hearing postpones the effective date of the department's decision until the conclusion of the hearing and issuance of a final decision by the board.
