Libby man arrested for domestic abuse

Timothy James Haag, a 51-year-old Libby man, was arrested Oct. 7 and charged with a misdemeanor count of partner or family member assault, causing bodily injury to partner or family member.

Lincoln County Sheriff’s deputy John Davis reported being dispatched to the home of Haag’s girlfriend on U.S. Highway 2 following a call to dispatch reporting an assault.

According to the narrative attached to the affidavit of probable cause, Davis arrived at the home in response to the call and discovered Haag had already left the scene. Davis interviewed the victim who said she and Haag had been in a relationship for about six months. The couple had a verbal confrontation earlier in the day, when Haag accused the victim of cheating on him. Haag then left the residence.

The victim said Haag returned to the residence at around 10:30 p.m. and broke in through a window.

“[Victim] stated that at about 10:30 p.m. Haag came back to her residence,” Davis wrote. “[Victim] stated that Haag broke into her residence through a window. Deputy [Boyd] White informed me that there was a ladder propped up against the window outside the residence consistent with someone climbing through the window.”

Once inside the residence, Haag reportedly became hostile and violent with the victim.

“[Victim] stated that Haag ‘freaked out on her,’ Davis wrote in his report. “[Victim] stated that Haag become physically violent with her. [Victim] stated that she was sitting on the couch and Haag hit her repeatedly in the head with his open hand. [Victim] stated that Haag then grabbed her and pulled her off the couch and onto the floor. [Victim] stated that she attempted to run out of the house. [Victim] stated that Haag then grabbed her by the arm and squeezed her very hard.”

Davis noted two large contusions on the inside of the victim’s upper arm consistent with someone grabbing the arm. He also noted a red contusion on the left side of the victim’s neck.

Davis’ report indicates the victim’s two young daughters were home at the time of the assault and that the daughters woke up and came into the living room during the altercation.

Davis and White located Haag in his vehicle at a local casino at approximately 1 a.m. Haag admitted breaking into the residence through the window and having an argument with the victim, but denied any physical contact. Davis arrested Haag on the scene and transported him to the Lincoln County Detention Center. 

Haag filed a notice of a not guilty plea in Lincoln County Justice Court Oct. 7 and is scheduled for an omnibus hearing Nov. 12 in front of Justice of the Peace Jay Sheffield.
